These Terms of Sale govern your purchase of products from Bikopia LLC (Bikopia). Throughout the site, the terms “we”, “us” and “our” refer to Bikopia LLC. By placing an order, you agree to be bound by these terms.

For website usage terms, please refer to our Terms of Service.

1. GENERAL TERMS (Applies to All Products)

1.1 Order Acceptance

Your order is an offer to purchase the products listed in your cart. Bikopia reserves the right to cancel or limit quantities at our sole discretion.

1.2 Payment

Payment is due at the time of order.

1.3 Shipping

Please refer to our Shipping Policy for details.

1.4 No Warranty

Unless otherwise stated below, Bikopia’s products do not carry a limited warranty against manufacturing defects, starting from the date of delivery. Additionally, Bikopia does not cover normal wear and tear, damage due to misuse, improper assembly, or unauthorized modifications.

1.5 Limitation of Liability

To the maximum extent permitted by law, Bikopia’s liability for any claim is limited to the purchase price of the product. We are not responsible for incidental, consequential, or indirect damages.

1.7 Consumer Rights and Arbitration

CONSUMER RIGHTS AND ARBITRATION: This arbitration provision affects your legal rights and remedies by providing that disputes between you and Bikopia LLC, its owners, employees, officers, managers, agents and assigns (“Bikopia”) must be resolved through binding arbitration, rather than in a court. Please read carefully as you accept these terms by either using this product or retaining this product for more than 30 days after purchase. If you do not agree to these terms, return the product prior to use to the location of purchase within 30 days for a refund. 

i)  RESOLUTION OF CLAIMS OR DISPUTES. Any claim or dispute between you and Bikopia arising out of or relating in any way to the product shall be resolved through final, binding arbitration. This arbitration obligation applies regardless of whether the claim or dispute involves a tort, fraud, misrepresentation, product liability, negligence, violation of a statute, or any other legal theory. Both you and Bikopia specifically acknowledge and agree that you waive your right to bring a lawsuit based on such claims or disputes and to have such lawsuit resolved by a judge or jury. All arbitrations described herein shall be conducted only on an individual (and not a class-wide) basis and an arbitrator shall have no authority to award class-wide relief. The user/installer acknowledges and agrees that this specifically prohibits the user/installer from commencing arbitration proceedings as a representative of others or joining in any arbitration proceedings brought by any other person. 

ii) ARBITRATION PROCEDURES. 

(1) Before commencing any arbitration proceedings, the user/installer must first present the claim/dispute to Bikopia by sending an e-mail to info@bikopia, providing contact information and the nature of the claim/dispute, and allowing Bikopia the opportunity to resolve it. If your claim or dispute is not resolved within sixty (60) days, you may commence arbitration proceedings in accordance with the terms herein. 

(2) The arbitration of claim(s)/dispute(s) hereunder shall be pursuant to the American Arbitration Association’s (“AAA”) United States Commercial Dispute Resolution Procedures and Supplementary Procedures for Consumer-Related Disputes (see www.adr.org for their rules and procedures). 

(3) The arbitration of any claim/dispute hereunder shall be in the Commonwealth of Kentucky and the law of the Commonwealth of Kentucky shall apply, without regard to principles of conflicts of law. If any provision herein is declared or found to be unlawful, unenforceable or void, such provision will be ineffective only to the extent that it is found unlawful, unenforceable or void and the remainder shall remain fully enforceable.

(4) All administrative expenses of arbitration proceedings hereunder shall be divided equally between the claimant and the Company. You acknowledge and agree that each party shall pay the fees and costs of its own counsel, experts and witnesses.

2. PRODUCT-SPECIFIC TERMS

2.1 Apparel

1) Apparel Defects

Bikopia apparel is not warranted against defects in materials and workmanship. Additionally, Bikopia is not responsible for:

  • Normal wear and tear, including pilling, fading, or stretching from regular use.

  • Damage caused by accidents, abuse, misuse, or improper care (including failure to follow care instructions).

  • Damage resulting from exposure to harsh chemicals, abrasive surfaces, or extreme environmental conditions.

  • Unauthorized alterations or repairs.

2) Apparel Care Instructions

Apparel must be cared for according to the care instructions printed on the garment’s label. Bikopia is not responsible for failure to follow care instructions.

Example care instructions include (but are not limited to):

  • Wash cold, gentle cycle.

  • Do not bleach.

  • Tumble dry low or hang dry.

  • Do not iron on prints or logos.

Always check the specific garment’s label for applicable instructions.

3) Apparel Fit & Sizing

It is the customer’s responsibility to select the correct size. Sizing charts are provided for reference but do not constitute a guarantee of fit. Returns due to sizing issues are subject to our Refund Policy.

4) Apparel Intended Use

Bikopia apparel is designed for recreational cycling and casual wear. Use in industrial, competitive, or extreme environments may accelerate wear and is not recommended.

5) Apparel Limitation of Liability

To the fullest extent permitted by law, Bikopia is not liable for:

  • Personal discomfort, allergic reactions, or sensitivities related to fabric materials.

  • Damage to other clothing or equipment worn in combination with Bikopia apparel.

  • Indirect, incidental, or consequential damages.

3. SAFETY NOTICES

Always follow the safety guidelines provided with your product. Misuse can result in injury or death. Bikopia LLC is not responsible for injuries caused by improper use.

4. CHANGES TO THESE TERMS

Bikopia LLC reserves the right to update these Terms of Sale. The version posted at the time of your purchase applies.
